The New York State Supreme Court is hearing arguments in a lawsuit brought by an author who says that The Great American Book of English is a “gigantic” text, but that the book is a little too large for its size and is too expensive for many readers.
Aksara Books is seeking a declaratory judgment from the court that the Supreme Court should strike down the statute, which has been in effect since 2000.
The book is called The New American Novel, and the court is set to rule on whether it’s a “true” or “false” book.
A case has been going on since 2009, when Aksaras lawsuit was filed.
It’s the latest in a long string of cases where the court has tried to strike down state-mandated limits on books.
The New Hampshire Supreme Court struck down a law that required schools to put down at least two novels a year, and a Pennsylvania judge ruled that a law banning children from reading to other children violated their rights to free speech.
The Supreme Court has said that it is not the place to make such sweeping and arbitrary rules.
The court has upheld the right of schools to allow students to read books they like.
The legal battle started when an American College of Sports Medicine group sued to overturn the state law that imposed a $50-per-year cap on the number of books students could read each year.
A 2014 survey by the group found that just 7 percent of adults had read The Great English Novel.
The Great Great American Story was the first novel by American author Henry James.
The American Booksellers Association sued the state for violating the First Amendment.
The case has drawn a large audience of lawyers and publishers, including Simon & Schuster, HarperCollins, Random House and Simon &Garten, which is behind the book.
“We’re very pleased that the New York Court has recognized that The New Great American is an extraordinary work of literature and that it should not be regulated in the same way that other books are,” said Aksaram Arora, vice president of communications at Aksars.
“The New Great English novel has been hailed as the greatest novel ever written and the bestseller in America.”
Aksaura Books, which was founded in New York City in 1998, has published more than 30 books, including The Great French Novel, The Great Russian Novel, A Woman’s Life in the City, The Story of New York and The Adventures of Tom Sawyer.
